2. Local Sales Tax Compliance

All orders shipped to Florida are subject to applicable state and local sales taxes, including Palm Beach County surtaxes, which will be calculated and displayed at checkout. Customers are responsible for ensuring compliance with their local tax obligations outside of Florida.

 

 

3. Refund and Return Compliance

All sales are final unless otherwise specified. Refunds or exchanges may be granted at our sole discretion. If approved, refunds will be issued to the original payment method.

In compliance with Florida regulations, businesses with a “No Refund” policy must clearly post the policy at the point of sale. By placing an order with us, you acknowledge and agree to this policy.

 

 

4. Third-Party Tools and Data

Our website integrates third-party tools and services to enhance your experience. These include:

  • Shopify: Hosting platform for our e-commerce store.
  • Loox or Judge Me Reviews: For collecting and displaying customer reviews.
  • CED Commerce: For marketplace integrations such as Etsy and TikTok.

  • PayPal and Shopify Payments: For secure payment processing.
  • Google and Meta Platforms: For marketing, tracking, and data analytics.

5. Arbitration Clause

Any dispute or claim arising out of or relating to these Terms, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Palm Beach County, Florida, and will be governed by Florida law.

Each party shall bear its own costs, and the arbitrator’s decision will be final and binding.

 

 

6. Liability Cap

To the fullest extent permitted by law, our liability for any claim arising from your use of our site, products, or services is limited to the total amount you paid for the specific product or service giving rise to the claim.

We shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, revenue, or data.

 

 

7. Shipping Liability

We are not responsible for delays caused by carriers or external factors beyond our control. Claims for damages occurring during shipping must be filed directly with the carrier.

 

 

8. Customization and Design Ownership

By submitting a custom design, you grant Click Coastal a non-exclusive, royalty-free license to use, modify, and reproduce the design solely for the production of your order.

Customization options are subject to design, manufacturing, and production limitations. We reserve the right to refuse designs that do not meet our requirements.

 

 

9. Force Majeure

We are not liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, pandemics, or disruptions to supply chains.
